General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions apply to all orders placed by customers via the online shop of Alex van de Sluis, trading under the name ratoh (ratoh.com), 1a, op der Knupp, L-4981 Reckange sur Mess, email: info@ratoh.com (hereinafter referred to as the "Seller").

2. Conclusion of contract

The product descriptions in the online shop do not constitute a legally binding offer, but rather an invitation to place an order. By clicking on the "Buy now" button, the customer submits a binding offer. The contract is concluded when the seller accepts the order by sending an order confirmation by email.

3. Prices and shipping costs

  • All prices are final prices and include statutory value added tax.

  • Any additional shipping costs will be clearly indicated during the ordering process.

  • Unless otherwise agreed, heavy plant pots or pallet goods will be delivered "free kerbside."

4. Special features of plants (live goods)

Since plants are natural products, the seller points out the following:

  • Deviations: Minor deviations in shape, colour size compared to the product images are natural and do not constitute a defect.

  • Care: Successful growth depends largely on proper care (watering, location, soil conditions) after receipt.

5. Right of withdrawal

The customer has a statutory right of withdrawal.

Please note: The right of withdrawal does not apply to goods that can spoil quickly or whose expiration date would be quickly exceeded (this applies to many plant species). For planter non-perishable goods, the 14-day right of withdrawal remains in full force.

6. Retention of title

The goods remain the property of ratoh until full payment has been received.

7. Warranty and liability for defects

The statutory warranty provisions apply. In the event of obvious transport damage (in particular to fragile pots or damaged plants), the customer is requested to report this immediately to the delivery company and to contact the seller within 24 hours.

8. Special manufacturer's warranty on planter

The seller provides planter 5-year warranty on selected planter . This warranty applies under the following conditions:

  • Proper installation: The tubs must be placed on feet or appropriate supports to avoid direct contact with the ground and the associated waterlogging or frost damage.

  • Water drainage: It must be ensured that the bucket has a functioning drainage hole so that excess water can drain away unhindered at all times.

  • Intended use: The warranty covers material and manufacturing defects, but does not cover damage caused by improper handling, external force, or modifications to the product that do not comply with the assembly instructions.

In the event of a warranty claim, the seller shall, at its discretion, replace the defective bucket or refund the purchase price. Further claims are excluded.

9. Terms of payment for services (landscaping)

The following terms and conditions apply to services and craftsmanship provided in the field of gardening and landscaping:

  • Payment terms: Unless otherwise agreed, invoice amounts are due for payment without deduction within 14 days of the invoice date.

  • Advance payments: The seller is entitled to request an advance payment when the order is placed. The exact amount of the advance payment and the corresponding payment deadlines are specified individually in the respective offer and are binding.

  • Priority of the offer: If different payment terms or deadlines are specified in the written offer, the provisions in the offer shall always take precedence over these General Terms and Conditions.

  • Late payment: If the payment deadline is exceeded, the customer is automatically in default. The seller reserves the right to charge default interest at the statutory rate and reminder fees.

10. Applicable law

The law of the Grand Duchy of Luxembourg applies. Forconsumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the country in which the consumer has his habitual residence is not withdrawn.
